III. General information on data processing

1. Scope of personal data processing

We only process our users‘ personal data to the extent necessary to provide a functional website and our content and services. Our users’ personal data is regularly processed only with the user’s consent. An exception applies in cases where it is not possible to obtain prior consent for practical reasons and the processing of the data is required by law.

2. Legal basis for the processing of personal data

Insofar as we obtain the consent of the data subject for the processing of personal data, Art. 6 (1) sentence 1 lit. a GDPR serves as the legal basis.

When processing personal data is necessary for the performance of a contract to which the data subject is party, Art. 6 (1) 1 lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary to carry out pre-contractual measures.

Insofar as the processing of personal data is required to fulfil a legal obligation to which our company is subject, Art. 6 (1) (1) (c) GDPR serves as the legal basis.

In the event that the vital interests of the data subject or another natural person require the processing of personal data, Art. 6 (1) (1) (d) GDPR serves as the legal basis.

If the processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not override the former interest, Art. 6 (1) sentence 1 lit. f GDPR serves as the legal basis for the processing.

3. Data erasure and storage duration

The personal data of the data subject will be deleted or blocked as soon as the purpose of storage no longer applies. Storage may take place beyond this if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject. Blocking or erasure of the data also occurs when a storage period prescribed by the standards mentioned expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract.

IV. Rights of the data subject

If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis the controller:

1. Right of access

You have the right to obtain from the controller confirmation as to whether or not personal data concerning you are being processed.

Where that is the case, you have the right to request access to the following information from the controller:

  • the purposes of the processing;
  • the categories of personal data being processed;
  • the recipients or categories of recipients to whom the personal data concerning you has been or will be disclosed;
  • the planned duration of the storage of the personal data concerning you or, if specific information on this is not possible, criteria for determining the duration of storage;
  • the existence of a right to correction or deletion of the personal data concerning you, a right to restriction of the processing by the controller or a right to object to this processing;
  • the existence of a right of appeal to a supervisory authority;
  • all available information about the origin of the data if the personal data is not collected from the data subject;
  • the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

You have the right to request information about whether your personal data is transferred to a third country or to an international organisation. In this context, you can request to be informed of the appropriate safeguards pursuant to Article 46 GDPR relating to the transfer.

2. Right to rectification

You have the right to request the controller to rectify and/or complete the data if the processed personal data concerning you is incorrect or incomplete. The controller must carry out the rectification without undue delay.

3. right to restriction of processing

You have the right to obtain from the controller restriction of processing where one of the following applies:

• the accuracy of the personal data is contested by you, for a period enabling the controller to verify the accuracy of the personal data• the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead• the controller no longer needs the personal data for the purposes of the processing, but they are required by you for the establishment, exercise or defence of legal claims• you have objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether the legitimate grounds of the controller override those of you.

  • the controller no longer needs the personal data for the purposes of the processing, but you require them for the establishment, exercise or defence of legal claims; or
  • if you have objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether the legitimate grounds of the controller override your grounds.

Where processing of personal data concerning you has been restricted, such data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

If the processing restriction has been restricted in accordance with the above conditions, you will be informed by the controller before the restriction is lifted.

4. Right to erasure

a) Erasure obligation

You have the right to obtain from the controller the erasure of personal data concerning you without undue delay and the controller has the obligation to erase personal data without undue delay where one of the following grounds applies:

  • The personal data concerning you are no longer necessary in relation to the purposes for which they were collected or otherwise processed.

b) Information to third parties

If the controller has made the personal data concerning you public and is obliged to delete it in accordance with Art. 17 para. 1 GDPR, he shall take appropriate measures, including technical measures, taking into account the available technology and the implementation costs, to inform data processors who process the personal data technical means, to inform data processors which are processing the personal data that you, as the data subject, have requested the deletion of all links to such personal data or of copies or replications of such personal data.

c) Exceptions

The right to deletion does not apply to the extent that processing is necessary

  • for the exercise of the right to freedom of expression and information.
  • to fulfil a legal obligation that requires processing under the law of the Union or of the Member States to which the controller is subject, or to carry out a task that is in the public interest or in the exercise of official authority that has been transferred to the controller;
  • for reasons of public interest in the area of public health in accordance with Art. 9 para. 2 lit. h and i as well as Art. 9 para. 3 GDPR;
  • for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with Article 89(3) of the GDPR in so far as the right referred to in paragraph 1 is likely to render impossible or seriously impair the achievement of the objectives of that processing; or
  • for the establishment, exercise or defence of legal claims.

5. Right to notification

If you have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to communicate any rectification or erasure of personal data or restriction of processing to each recipient to whom the personal data concerning you have been disclosed, unless this proves impossible or involves disproportionate effort.

You have the right to request that the data controller inform you of the recipients.

6. Right to data portability

You have the right to receive the personal data concerning you, which you have provided to the controller, in a structured, commonly used and machine-readable format. You also have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where

  • the processing is based on consent pursuant to Article 6(1) sentence 1 point (a) GDPR or Article 9(2) point (a) GDPR or on a contract pursuant to Article 6(1) sentence 1 point (b) GDPR and
  • the processing is carried out by automated means.

In exercising this right, you also have the right to have the personal data concerning you transferred directly from one controller to another, insofar as this is technically feasible. The freedoms and rights of other persons must not be affected by this.

The right to data portability shall not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

7. Right to object

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Article 6(1) GDPR, including profiling based on those provisions.

The controller will no longer process the personal data concerning you unless the controller demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

Where personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.

Where you object to processing for direct marketing purposes, the personal data concerning you will no longer be processed for such purposes.

You have the option, in the context of the use of information society services, and notwithstanding Directive 2002/58/EC, to exercise your right to object by automated means using technical specifications.

8. Right to revoke the declaration of consent under data protection law

You have the right to revoke your declaration of consent under data protection law at any time. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

9. automated decision in an individual case, including profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. This shall not apply if the decision

  • is necessary for entering into, or performance of, a contract between you and the data controller,
  • is authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard your rights and freedoms and legitimate interests; or
  • is based on your explicit consent.

However, these decisions must not be based on special categories of personal data referred to in Article 9(1) of the GDPR, unless point (a) or (b) of Article 9(2) of the GDPR applies and suitable measures to safeguard your rights and freedoms and legitimate interests are in place.

With regard to the cases referred to in points 1 and 3, the controller shall implement suitable measures to safeguard your rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and to contest the decision.

10. Right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.

The supervisory authority with which the complaint has been lodged shall inform the complainant on the progress and the outcome of the complaint including the possibility of a judicial remedy pursuant to Article 78 of the GDPR.
